Introduction & acceptance
These Terms of Service ("Terms") govern your use of the Brainy Bookstore online store, operated by Brainy LLC ("we", "us", "our"). By accessing or using the site, placing an order, or creating an account, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the site.
Eligibility & accounts
You must be at least 16 years old to create an account or place an order. When registering you agree to provide accurate and current information, including a valid phone number and email address. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us promptly of any unauthorised use. The site is intended for personal, non-commercial use.
Products, availability & pricing
All prices are shown in Armenian Dram (AMD) and include applicable taxes unless stated otherwise. We make every effort to display products and prices accurately, but errors may occur. We reserve the right to correct any errors and to change prices, descriptions, or availability at any time without notice. If an item is out of stock after you order, we may cancel the affected items and refund you in full.
Orders & payment
Your order is an offer to purchase. A contract is formed only when we send you an order confirmation. We may decline or cancel an order at our discretion (for example, suspected fraud or stock errors). Payment is processed through AmeriaBank's ArCa payment gateway and accepts Visa and Mastercard with 3-D Secure authentication. Card details are entered directly on the bank's secure page — your full card data is never stored on or transmitted through our servers.
Delivery
We offer courier delivery within Yerevan, regional post across Armenia, and free in-store pickup at our shop. Applicable delivery fees and estimated timeframes are shown at checkout before you confirm your order. Delivery times are estimates and may vary due to factors outside our control. Risk in the goods passes to you on delivery or collection.
Returns, refunds & cancellation
You may return eligible items within 14 days of delivery, provided they are unused and in their original condition and packaging. To start a return, contact us with your order details. Once we receive and inspect the returned goods, we will refund the purchase price to your original payment method within a reasonable period. The cost of return shipping is paid by the customer, except where the item is defective or incorrectly supplied, in which case we cover it. This policy does not affect your statutory consumer rights.
Intellectual property
All content on this site — including the Brainy Bookstore name and logo, design, graphics, and text — is owned by or licensed to Brainy LLC and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the site without our prior written permission. Product titles, cover images, and descriptions remain the property of their respective rights holders.
Acceptable use
You agree to use the site lawfully and not to: place fraudulent orders; interfere with the security or operation of the site; attempt to gain unauthorised access to our systems or other users' accounts; use automated tools to scrape or overload the site; or post unlawful, infringing, or harmful content. We may suspend or close accounts that breach these rules.
Disclaimers & limitation of liability
The site is provided "as is" and "as available". To the fullest extent permitted by law, we do not warrant that the site will be uninterrupted or error-free. We are not liable for indirect, incidental, or consequential losses, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under the law of the Republic of Armenia, including consumer protection rights.
Governing law & disputes
These Terms are governed by the laws of the Republic of Armenia. We will try to resolve any dispute amicably; if we cannot, disputes will be subject to the competent courts of the Republic of Armenia. Your mandatory statutory consumer rights remain fully preserved and are not limited by these Terms.
Changes to these terms
We may update these Terms from time to time. The current version is always available on this page, with the "Last updated" date shown above. Material changes take effect when posted; your continued use of the site after a change means you accept the revised Terms.
